3.4 All product specifications stated in Seller’s literature are not binding, as products are constantly being improved and or changed.

4.0 All products are subject to return or exchange only according to our Return Policy. (Section 10)

4.1 Certain products may be available exclusively online through the website. These products may have limited quantities and or delivery timescales,

4.1 We reserve the right, but are not obligated to limit the sales of our products or Services to any person, company, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.

4.2 All descriptions and specification of products or product pricing are subject to change at any time without notice.

4.3 We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

4.4 We reserve the right to refuse any order.

Acceptance

5.0 All orders are subject to review and final acceptance by Seller at its office in Wroughton, Swindon, Wiltshire in the UK. In the event of any conflict between buyers order and Sellers’ terms and conditions set forth herein, these terms and conditions shall prevail and the issuance of such order by Buyer shall be deemed to be Buyer’s assent to the foregoing.

Cancelation

6.0 After acceptance by Seller, Buyer’s order is not subject to cancellation, change, reduction in amounts, or suspension or delay of shipment, except with Seller’s written consent.
Cancelled orders consented to by Seller are subject to full cancellation charges, based upon expenses incurred by Seller up to the time of cancellation (including a reasonable profit on such expenses). A minimum cancellation charge of 25% will be applied, regardless of the expenses incurred by Seller.

Payment Terms

7.0 Prepayment purchase for all website based orders

Shipments

8.0 Shipments are made by third party courier and tracking details will be supplied. Your phone number will be forwarded to the courier only for assistance (if required) in making your delivery. All other buyer personal details will remain confidential as per our website privacy policy.

8.1 Product lead times vary and are subject to change without notice. Indicative and estimated delivery times only are advised on the website. 

8.2 Delivery periods are not guaranteed

8.3 We shall not be liable to you nor to any third-party for any delivery’s that vary in any way from what was originally estimated.

Claims and Shortages

9.0 Claims against Seller for shortages in the amount shipped must be made to Seller within Seven (7) calendar days after receipt of shipment. Claims shall be supported by photographic or other evidence.

Product returns

10.0 Best Scientific, are committed to making sure Buyers are completely satisfied. If by chance a Buyer would like to return a product Best Scientific asks the following:

10.1 Buyer must notify Best Scientific in writing within 7 days of receiving the delivery of their product with the reason for requesting a return

10.2 Buyer must obtain a return authorization number (RMA) by contacting Seller’s customer service department at +44 (0)1793 812477 or email james@bestscientific.co.uk Return authorizations are valid for 10 days from date of issue.

10.3 Products must be returned in original packaging and the return authorization number must be clearly noted on the shipping carton.

10.4 From 8 to 120 days, a minimum 25% restocking fee for standard products (not including Backorder, Special order, or Custom order products) will be charged for all returns if the item is received in its original packaging and is unopened. 

10.5 After 120 days returns will not be accepted unless otherwise related to a specific warranty claim, only products found to be defective will be accepted for repair or replacement for a period of one (1) year from date of invoice.

10.6 All returned products are subject to inspection. Products displaying use, misuse, or other damage will not be accepted. It is recommended that returns are packaged with extra due care and attention with suitable materials to protect them in transit.

10.7 Backorder, Special order, or Custom order products cannot be returned under any circumstances.

10.8 Shipping and handling charges will not be refunded.

10.9 Software product does not qualify for a refund.

10.10 Refunds are issued by wire transfer for pre-paid merchandise. Credit card order refunds are issued to the credit card or seller’s open account to which the product was originally charged.

Limited Warranty

11.0 Seller warrants that the products sold by it will, upon shipment, be free of defects in material and workmanship for a period of 12 (twelve) months from the date of shipment. The sole responsibility of seller under these warranties shall be to replace or repair, in place or elsewhere, at seller’s option, any part of parts which are proved to be other than as stated above; provided, however, that written notice is made by buyer to seller within seven (7) calendar days after discovery of the claimed violation of these warranties, but in any event, within the time limits herein specified. Buyer shall bear all expenses for freight, insurance and the risk of loss in transit incident to such replacement or repair. These warranties shall not apply to any product or part thereof which has been subjected to misuse or neglect, damaged by accident, rendered defective by reason of improper installation or by the performance of repairs or alterations outside the seller’s factory, except when performed by seller’s accredited service technician. These warranties shall not apply to any part or parts furnished by buyer or acquired from others at buyer’s request and/or to buyer’s specifications. The implied warranties of merchantability and fitness are excluded. The warranties contained herein are in lieu of any and all other warranties or representations whether expressed or implied and of any other obligation or responsibility of seller to buyer or the use of said product, including without limitation special, incidental, consequential and indirect damages or damages resulting from loss of use, interruption of business, or lost profits, even if the seller has been advised of the possibility of such damages. Notwithstanding the foregoing, in no event shall the seller’s aggregate liability to the buyer and its customers exceed the amount paid for products purchased under this agreement in the prior 6 months. No agreement or understanding bearing upon or extending the warranty or remedies set forth herein will be binding upon seller unless seller had agreed thereto in writing.

13.2 This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only.

Governing Law

Each party hereby irrevocably consents to the venue and jurisdiction of the courts of the UK Each party agrees that all controversies based upon, related to, arising from, or in connection with these Standard Terms and Conditions shall be litigated only in courts situated in the UK.

Taxes

20.0 Seller collects standard rate VAT on shipments to the UK and Northern Ireland

20.1 Buyers outside the aforementioned states are responsible for their state or local sales/use tax, if any, and any other taxes payable by reason of this transaction.

Indemnification

21.0 You agree to indemnify, defend and hold harmless Best Scientific and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Severability

22.0 In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
